These Terms of Service govern your use of DivePilot. By creating an account, you agree to these terms. Please read them carefully — they are written in plain language.
DivePilot is a cloud-based dive center management platform ("Service") developed and operated in Switzerland. The Service is accessible at my.divepilot.app.
These Terms of Service ("Terms") form a legally binding agreement between you ("Customer", "you") and DivePilot ("we", "us"). By registering an account, you agree to be bound by these Terms.
To use DivePilot you must:
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at support@divepilot.app.
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial.
At the end of the trial period, your account will be downgraded unless you subscribe to a paid plan. Data is retained for 90 days after trial expiry before permanent deletion.
Promotional codes (such as TRIAL3) may extend the trial period. Promotional offers may not be combined unless explicitly stated. We reserve the right to modify or withdraw promotional offers at any time.
Paid subscriptions are billed in advance on a monthly or yearly basis. Prices are shown in USD and vary by region as displayed during checkout.
Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
You agree to use DivePilot only for lawful purposes. You must not:
Violation of these rules may result in immediate account suspension without refund.
You retain full ownership of all data you enter into DivePilot, including customer data, booking records and operational data.
By using the Service, you grant us a limited license to store, process and display your data solely for the purpose of providing the Service to you.
You are responsible for ensuring you have the legal right to collect and store personal data about your customers in your jurisdiction, including obtaining any necessary consents.
You can export your data at any time. Upon account deletion, data is permanently purged within 90 days.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We aim to provide a reliable service but do not guarantee uninterrupted availability. We perform maintenance periodically which may cause brief outages. We will notify customers of planned maintenance in advance where possible.
We are not liable for any loss resulting from temporary unavailability of the Service.
DivePilot, its logo, design and all software are the intellectual property of DivePilot. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the Service as described here.
To the maximum extent permitted by applicable law, DivePilot shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunity, arising from your use of the Service.
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
You may cancel your account at any time from the billing settings in the platform.
We may suspend or terminate your account if:
Upon termination you will lose access to the Service. Your data will be retained for 90 days after which it will be permanently deleted.
We reserve the right to modify, improve or discontinue features of the Service at any time. We will notify customers of significant changes by email and in-app notification. Continued use after notification constitutes acceptance.
Pricing may change upon renewal. We will notify you at least 30 days before any price change takes effect on your subscription.
These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Switzerland, unless mandatory consumer protection laws in your country of residence provide otherwise.
We may update these Terms from time to time. When we do, we will update the "Last updated" date and notify account holders by email for material changes. Continued use of the Service after notification constitutes acceptance of the updated Terms.
